Terms & Founding Beta Agreement
Effective September 18, 2026
These terms apply to the On the Wall Art Preview Studio founding beta offered by Ken Stoecklin Photography (“On the Wall,” “we,” “us,” or “our”). By purchasing or using On the Wall, you agree to these terms.
1. The founding-beta offer
The founding-beta price is a one-time payment of $39. It includes the version delivered to you plus updates released during the 12 months following your purchase date. You may keep using the version you purchased after that update period ends. There is no subscription or automatic renewal. Future upgrades, premium features, cloud services, app-store availability and specific release dates are not promised and may be offered separately.
2. Who may use it
The founding beta is intended for adults age 18 or older located in the United States. You need a reasonably current web browser, an internet connection for initial access and updates, and sufficient device storage.
3. Your license
We grant you a limited, non-exclusive, non-transferable license to keep and use the version of On the Wall delivered with your purchase for your own art or photography business, subject to these terms. You may use exported room mockups to market and sell artwork you are authorized to represent. You may not copy, reverse engineer, sublicense, rent, resell, redistribute or provide shared access to the app, its code, built-in rooms or other included assets.
4. Your artwork and content
You retain ownership of artwork, logos, names and other material you add. You represent that you own or have permission to use that material. You may not use On the Wall for unlawful, infringing, deceptive, abusive or harmful content.
5. Device storage and backups
The founding beta stores uploaded artwork, branding and settings locally in the browser on the device you use. It does not currently include an account, cloud library or automatic cross-device synchronization. Clearing browser data, removing an installed web app, changing devices or device failure can remove locally stored information. You are responsible for keeping your original artwork and using the included Backup Library feature.
6. Approximate previews
Room previews are presentation tools, not architectural measurements or installation plans. Apparent scale depends on the dimensions you enter and the reference dimensions assigned to each room. Buyers and installers should confirm physical measurements before ordering or installing artwork.
7. Beta software and availability
The service is an early release and may contain bugs, interruptions or incomplete features. We may improve, replace or remove beta features. We do not promise that On the Wall will be uninterrupted, error-free, compatible with every device, or produce any particular business, marketing or sales result.
8. Final-sale policy
Because On the Wall is a digital product with immediate access, all sales are final once access is delivered.
We do not provide refunds for change of mind, unused access, device-storage loss, buyer failure to meet the stated requirements, or features that were identified as unavailable during beta. If we fail to deliver access or a material access problem caused by us cannot be corrected, contact us within seven days so we can restore access or provide any remedy required by applicable law. This policy does not limit rights that cannot legally be waived.
9. Support
Founding users receive reasonable email support and may submit product feedback. The beta does not include guaranteed response times, custom development, artwork editing, device repair or business consulting.
10. Ownership
On the Wall, its software, branding, interface and supplied assets are owned by us or their respective licensors. Except for the limited license above, no ownership rights are transferred to you.
11. Disclaimer and liability
To the fullest extent allowed by law, On the Wall is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose or non-infringement. We are not liable for indirect, incidental, special, consequential or lost-profit damages. Our total liability relating to the beta will not exceed the amount you paid for On the Wall. Some jurisdictions do not permit every limitation, so those limitations apply only to the extent allowed by law.
12. Suspension or termination
We may suspend access for misuse, infringement, fraud, attempts to compromise the service or material violation of these terms. Sections concerning ownership, disclaimers, liability and governing law survive termination.
13. Changes and governing law
We may update these terms as the beta develops. Material changes will be presented before they apply to a new purchase or renewal. These terms are governed by Arizona law, without regard to conflict-of-law principles, except where another law must apply.
